Decisions

The director holds a statutory role with power to make determinations in respect to certain liquor matters under the Liquor Act 1978, the Liquor Act 2019 or the Liquor Commission Act 2018. The director’s decision and reasons are published in a written notice.

Review of decisions

Applicants can seek a review of the decision before the Liquor Commission, the Northern Territory Civil and Administrative Tribunal or the Northern Territory Supreme Court.

Delegate decisions, including enforceable undertakings

Under section 11 of the Liquor Act 2019 the director may delegate the decision making power to a public sector employee.

Liquor Commission register of enforcement matters

Section 169 of the Liquor Act 2019 requires the director to record any enforceable undertaking and any disciplinary action taken by the Liquor Commission and to publish the register on the director’s website.

The register must contain the following information:

1. the name and address of the licensee involved
2. the date of any disciplinary action or any enforceable undertaking
3. a copy of all decisions of the commission regarding any disciplinary action
4. a copy of any enforceable undertaking
5. the details of any expiry, withdrawal or variation of an undertaking.
